Terms of Service & Acceptable Use
Business Detonator · Version 2026-09-21
This service is provided on an experimental, recreational, as-is basis, is operated by automated AI systems with no human technical support, and comes with no warranty. You are responsible for your own legal compliance. Sending spam or unsolicited messages will get your account suspended, deactivated, or banned. By continuing you agree to the full terms below.
1. Nature of the Service — Experimental & Recreational
The Business Detonator platform and every feature within it (including Detonator CRM, the Content Engine, the Executive Assistant, and Detonator Sites) are made available to you (the "Subtenant") on an experimental and recreational basis. The service is offered for you to explore, test, and use at your own discretion and risk. It is not represented, sold, or warranted as a fit for any particular business, professional, regulatory, or mission-critical purpose.
Because the service is experimental, features may change, degrade, or be withdrawn at any time without notice, and results, outputs, and availability are not guaranteed. You should not rely on the service as the sole system of record for anything you cannot afford to lose, and you are responsible for keeping your own independent backups of your data.
2. Automated / AI-Operated — No Human Technical Support
The service is operated and administered primarily by automated and artificial-intelligence systems. Content, messages, replies, recommendations, and automated actions may be generated by AI and may be inaccurate, incomplete, or unsuitable. You are responsible for reviewing anything the service produces before you rely on it or send it to a third party.
There is no human technical support offered with this service. Business Detonator does not commit to any response time, staffed help desk, account management, or human intervention of any kind. Any assistance that may be provided is discretionary, best-effort, and may itself be delivered by automated systems.
3. No Warranty — Provided "As Is"
The service is provided "AS IS" and "AS AVAILABLE," with all faults and without warranty of any kind. To the fullest extent permitted by law, Business Detonator and the Company disclaim all warranties, express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement.
Business Detonator does not warrant that the service will be uninterrupted, secure, error-free, or free of harmful components, or that any data, output, or result will be accurate or reliable. No advice or information, whether oral or written, obtained from the service creates any warranty not expressly stated here.
4. Limitation of Liability
To the fullest extent permitted by law, in no event will the Company, its owners, officers, directors, employees, agents, contractors, affiliates, successors, or assigns (together, the "Company Parties") be liable to you or to anyone claiming through you for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business, arising out of or relating to the service, however caused and under any theory of liability, even if advised of the possibility of such damages.
To the extent any liability cannot be disclaimed, the total aggregate liability of the Company Parties for all claims relating to the service will not exceed the greater of the amounts you actually paid for the service in the three (3) months before the event giving rise to the claim, or one hundred U.S. dollars (US$100). You acknowledge that this allocation of risk is a fundamental basis on which the service is made available to you.
5. Acceptable Use — Anti-Spam Policy
You may send messages, emails, and other communications through the service ONLY to recipients who have given you a lawful basis to contact them — for example, a genuine opt-in, an existing business relationship, or another basis permitted by applicable law. You must not use the service to send spam, unsolicited bulk messages, or any message to a recipient who has not consented to hear from you or who has opted out, unsubscribed, or asked you to stop.
You must honor every opt-out and unsubscribe request promptly, keep your own records of consent, include a working unsubscribe mechanism in bulk email, and never send to purchased, scraped, harvested, or rented contact lists. Sending mail that damages sending-domain reputation — through high bounce rates, spam complaints, or unsolicited volume — is prohibited.
Business Detonator operates automated safeguards that may block, delay, throttle, or refuse a send before it goes out when it appears to violate this policy or to put sending reputation at risk. These safeguards are protective, not a guarantee, and do not relieve you of your own responsibility for what you send.
6. Enforcement — Suspension, Deactivation & Ban
If you violate this Acceptable Use Policy — including by spamming or sending uninvited or unsolicited messages — Business Detonator may, at its sole discretion and without prior notice, suspend your sending, suspend or deactivate your account, or permanently ban you from the service. Automated systems may take any of these actions, and may do so immediately to protect other users and sending reputation.
Suspension or deactivation may occur before a message is sent. Reinstatement, if any, is at the Company's sole discretion. You remain responsible for any consequences of communications you sent, or attempted to send, in violation of this policy.
7. Your Legal Compliance
You are solely responsible for your own compliance with all laws and regulations that apply to your use of the service and to the communications you send, including (without limitation) the CAN-SPAM Act, the Telephone Consumer Protection Act (TCPA), 10DLC and carrier messaging requirements, marketing and consent laws, data-protection and privacy laws, and any rules governing your industry.
You are responsible for obtaining and maintaining all consents, permissions, and disclosures required for the contacts you load and the messages you send. Business Detonator is a tool; the legal obligations for how you use it, and for the content and recipients of your communications, are yours.
8. Indemnification (Including Estates)
You, on behalf of yourself and your heirs, executors, administrators, successors, assigns, and estate, agree to defend, indemnify, and hold harmless the Company and its owners, officers, directors, employees, agents, contractors, and affiliates, together with each of their respective heirs, executors, administrators, successors, assigns, and estates (together, the "Indemnified Parties"), from and against any and all claims, demands, actions, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of or relating to: your use of the service; the communications you send or attempt to send; your violation of these terms or of any law; or your infringement of any third party's rights.
This indemnity, and every release and limitation in these terms, is intended to protect the Indemnified Parties and their estates from you and from your estate, and survives the termination of your account and, so far as the law allows, the death or incapacity of any person on either side. It binds and benefits the heirs, successors, and estates of both you and the Indemnified Parties.
9. General
Business Detonator may change these terms at any time; your continued use of the service after a change takes effect is your acceptance of the updated terms. If any provision of these terms is held unenforceable, the remaining provisions remain in full force, and the unenforceable provision will be enforced to the maximum extent permitted.
These terms are the entire agreement between you and the Company regarding the service and supersede any prior understanding on that subject.
